By accessing or using WhenBRRR ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

WhenBRRR is a market intelligence platform that provides Money Tide Index (MTI) calculations, budget allocation recommendations, and marketing automation tools.

2. Service Description

WhenBRRR provides:

• Market Intelligence: Real-time MTI and SNI calculations based on macroeconomic data
• Budget Allocation: AI-powered marketing budget recommendations across 8 channels
• Integrations: Connections to HubSpot, Salesforce, and NimbusOS platforms
• Analytics: Campaign tracking, ROI analysis, and forecasting tools
• Enterprise Features: Audit logging, compliance dashboards, and team management

3. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information
• Notifying us immediately of any unauthorized use

4. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Reverse engineer or attempt to extract source code
• Use automated systems to access the Service beyond API rate limits
• Share your account with unauthorized users

5. Subscription & Payment

• Subscriptions are billed monthly or annually in advance
• All fees are non-refundable unless otherwise stated
• We reserve the right to change pricing with 30 days notice
• Failed payments may result in service suspension

6. Data & Intellectual Property

Your Data: You retain ownership of all data you input into WhenBRRR. By using the Service, you grant us a license to process your data to provide the Service.

Our IP: WhenBRRR, the MTI algorithm, and all platform content remain our intellectual property. You may not copy, modify, or distribute our technology.

7. API Usage

API access is subject to:

• Rate limits based on your subscription tier
• API key confidentiality requirements
• Prohibition on reselling API access
• Fair use policies for server resources

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHENBRRR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Termination

• You may cancel your subscription at any time
• We may terminate accounts that violate these terms
• Upon termination, you may request data export within 30 days
• Sections 6, 8, 9, and 11 survive termination

11. Governing Law

These Terms are governed by the laws of Delaware, USA. Any disputes shall be resolved in the courts of Delaware.

12. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.
